DATE/TIME: Thursday, September 25th, 2003 / 05:30 PM

At about 9:55 p.m. Wednesday night, the Department received several calls for “shots fired” in the 200-block of Brandywine Avenue. A caller reported seeing a black male running south on Brandywine after the incident, and stated that he dropped what appeared to be a gun, retrieved it, and then ran into a house on Brandywine. The caller then advised that the subject had exited the house, and was running north on Brandywine. A description of the subject was given to responding patrol units, and a man fitting the description was stopped near 336 Brandywine. He was identified as Damien Devone, 21, of 1511 Rugby Road, Schenectady. Upon stopping Devone, officers observed that he had a gunshot wound to his lower left leg. Devone told officers that he had been shot by a black male in a black car, but he provided no other details. Devone was treated at the scene by Schenectady Fire Department paramedics and transported to Ellis Hospital where he was treated and released.

Officers checking the area for witnesses and evidence saw a woman enter the same apartment that Devone had reportedly entered and exited after the shooting. Officers learned from the woman that Devone was her cousin. While inside the apartment, officers located a loaded 9mm handgun inside the apartment.

Through their investigation, detectives believe that Devone had some type of confrontation with the occupants of the black car, pulled out the 9mm handgun that officers recovered, and fired the weapon, accidentally shooting himself in the lower left leg.

At this time, there is no evidence that Devone was shot by another person. The black car and its occupants have not been located.

Devone has been charged with Criminal Possession of a Weapon-3rd degree (a felony) and Unlawful Possession of Marihuana (a violation).

He was arraigned in Schenectady Police Court this morning and remanded to the Schenectady County Jail.
